The Digital Personal Data Protection Act, 2023 (Act No. 22 of 2023) is India’s national law governing how organizations collect, use, store, and share the personal data of individuals. It sets out obligations for data fiduciaries, rights for data principals, breach reporting duties, and penalties for non-compliance. The DPDP Rules, 2025 were notified in November 2025 and set out how those obligations work in practice.

Any organization that processes the digital personal data of individuals in India must comply, regardless of its size or sector. The Act also applies outside India where an organization processes the personal data of people in India in connection with offering them goods or services. That reach covers enterprises, government bodies, MSMEs, and startups alike.

Penalties run to a maximum of ₹250 crore for a single instance of non-compliance, with the Data Protection Board determining the amount based on the nature, gravity, and duration of the breach. The DPDP Rules, 2025 were notified in November 2025, and obligations are being switched on in phases through 13 May 2027. That staged timeline is the window organizations have to get consent mechanisms, breach procedures, vendor contracts, and governance in place — not a reason to wait, because most of the work takes longer than the time remaining.

A Significant Data Fiduciary must appoint a Data Protection Officer based in India who reports to the board or its governing body. Other organizations are not required to appoint one, but many still need someone accountable for privacy in practice.
